Municibid Privacy Policy

This Privacy Policy is provided by Municibid.com, LLC (“Municibid”), a Pennsylvania limited liability company. This Privacy Policy is intended to inform Municibid’s Users, as defined below, and users of the Municibid website and associated services about Municibid’s practices related to Personal Data or Personally Identifiable Information.
Municibid respects data privacy and applicable data privacy rights. Municibid aims to process and store Personal Data received from Users, Customers, and third parties in accordance with applicable data protection laws.
Definitions
“Customer” means a User of Municibid who creates a User Account with the Website.
“Data Subject,” “You,” or “Your” means any person whose Personal Data is collected or processed by Municibid.
“Personal Data” or “Data” means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, including by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
“Website” means the Municibid website and associated services.
“User” means any user of the Municibid Website, including Customers. Users may include individuals or entities that use Municibid’s services for buying or selling.
“User Account” means an account provided by Municibid to Customers, which provides additional access to the Website and certain services available only to Users who create a User Account.
Data Collected
Municibid collects Data in several ways.
First, Municibid collects general data that is automatically generated when a User connects to or uses the Website. This information may include cookies, website analytics, IP address, device information, browser information, and other technical data that is not primarily intended to identify the User, but is collected for recordkeeping, security, analytics, and service improvement purposes (“Technical Data”).
Municibid also collects personally identifiable information provided by Users when they create a User Account or otherwise interact with the Website. This information may include the User’s name, email address, mailing address, phone number, credit card information, and other related data (“Customer Data”). Municibid may also collect less sensitive information, including contact information and preferences related to marketing and viewing of the Website (“Marketing Data”).
Additionally, Municibid collects and retains Data pertaining to transactions that occur through Municibid’s services (“Business Data”). Business Data is collected in a manner that is generally apparent to the User based on the User’s activity on the Website. This Data may include information pertaining to auctions, sales, postings, item descriptions, images, displayed information provided by a User when selling a product or service, and information generated when Users place bids on products or services offered by other Users.
Business Data may also include financial information, communications between Users, mailing addresses for delivery or pickup, government identification numbers, date of birth, and other related Data that Municibid requires, is entitled to collect under applicable law, or may need for authentication, identification, verification, transaction processing, fraud prevention, legal compliance, or dispute resolution.
Municibid requires bidders to provide a government ID to verify that all bidders are of legal age to bid on Municibid and are United States or Canadian residents. IDs may also be required by some government sellers. Municibid relies on the third-party service Passcode to assist in the verification of IDs. Users must review and agree to Passcode’s legal terms and Privacy Policy during the verification process.
Data Collection Methods
Municibid collects Data in several ways. Users generate Data for Municibid when they create User Accounts, place an order, subscribe to newsletters, fill out forms, use Municibid’s live chat feature, open a support ticket, enter information on the Website, or provide Municibid with feedback.
Users are not notified each time Data is collected. Rather, Users are on notice that information submitted through the Website is voluntary and that Municibid may collect, process, and retain such Data in accordance with this Privacy Policy.
Use of Data
Municibid collects and uses Data in order to fulfill its contractual obligations to Users, provide and improve its services, comply with legal obligations, prevent fraud or misuse, and operate the Website.
Fulfillment of Contract
Municibid has contractual duties related to brokering sales between Users, as further described in Municibid’s Terms of Use. To accomplish these duties, Data is used to enter into and perform contractual relationships with Users.
Data may be used to enable and perform transactions with other Users, including the transmission of Personal Data where necessary to perform a transaction, including transactions that are started but not completed. Data may also be used to enable delivery, pickup, or transfer of purchased items. Some Data may be displayed publicly or semi-publicly through auction pages or listing pages created by Users, and may be retained by Municibid or transferred to other Users when appropriate for a transaction. This Data may include pickup or drop-off locations, contact information of Users buying or selling products, and related information necessary to enable the transaction.
Release of Data for Legal Obligations
Due to the transactional nature of Municibid’s Website, legal obligations, subpoenas, court orders, regulatory requests, or similar legal processes may require disclosure of Data. Municibid will comply with valid legal obligations and legal processes.
Vital Interests of Another Natural Person
Municibid may disclose Data to prevent, detect, mitigate, or investigate unlawful activities, fraud, safety risks, or other conduct that may impair a User’s vital interests or the vital interests of another natural person. In such events, Municibid may disclose Data to assist in preventing or responding to harm.
Additional Information for Payments
In addition to Municibid’s contractual obligations to Users, Municibid may share Data with third-party financial institutions, payment processors, or related service providers in order to perform transactions. This Data is shared only with institutions or providers that require such Data to perform the transaction or related services. Users agree to allow these third-party financial institutions and service providers to use their Data in a manner appropriate for the transaction. Such third parties should not use User Data for purposes unrelated to the financial transaction or related services they provide.
Consent
For purposes not otherwise described in this Privacy Policy, Municibid may use Data from Users where Users have provided consent.
Miscellaneous Uses
In events not already described in this section, Municibid may use User Data to optimize the Website, improve the User experience, enhance the overall ease and functionality of Municibid’s services, support customer service, monitor performance, analyze trends, and improve product features. This may include the use of User preferences, User feedback, and general usage patterns.
Protection of Data
Municibid makes security a priority and uses security measures designed to protect against unauthorized access to, or unauthorized modification, publication, or destruction of, Data. These security measures may include internal audits of data collection, storage, and processing practices, as well as physical, technical, and administrative security measures to protect systems where Municibid stores Data.
Municibid restricts Data access to Municibid employees, contractors, agents, and service providers who need such information in order to provide, develop, maintain, protect, or improve the Website and associated services. These individuals and entities are subject to confidentiality obligations and may be subject to discipline, termination, or legal action if they fail to meet those obligations.
Municibid does not maintain all Data independently. In the event Data is stored through third-party companies or service providers, those third parties may maintain the Data as necessary to provide services to Municibid. Such Data should not be used by third-party companies except as disclosed in this Privacy Policy, as necessary to provide services, or as otherwise permitted by applicable law.
Data may be maintained on an indefinite basis unless otherwise required by law, operational needs, contractual obligations, legal retention requirements, or Municibid’s internal practices. User Accounts may be maintained indefinitely.
Cookies
Cookies are portions of information about when and how Users access the Website. Municibid collects cookies and similar technologies from Users who utilize the Website to improve the User experience, operate the Website, provide services, analyze traffic, and improve Municibid’s services.
Users can set their external browser to notify them when a cookie is sent. Users can decide whether to accept or refuse cookies. However, if a User chooses to turn off cookies, it may affect the User’s ability to access or use certain features of the Website.
Third-Party Services
Municibid may need to share or transmit Data to third-party service providers in order to provide services through the Website. Municibid will advise Users when Data is shared with third-party service providers or vendors where required by law or where otherwise appropriate.
Disclosures of Data to third-party companies may occur for transactions, support, payment processing, identity verification, analytics, hosting, communications, security, fraud prevention, or other services that Municibid uses to fulfill contractual obligations, operate the Website, improve services, or comply with applicable law.
For third-party services, any collection, processing, transfer, or storage of Data by that third party may be handled according to the third party’s privacy policy and terms. Users should refer to those third-party policies and terms of use for additional information.
AI and ChatGPT App Interactions
Municibid may make certain public auction discovery features available through third-party AI or chat interfaces, including the Municibid ChatGPT App. These interfaces may allow Users to search active auctions, view public listing details, review historical sold comparable auctions, view public seller or agency summaries, and receive rough informational market value estimates based on historical Municibid auction data.
When Users interact with Municibid through ChatGPT or another third-party AI interface, their interactions may also be processed by that third-party provider according to that provider’s terms of use and privacy policy. Users should review the applicable third-party provider’s terms and privacy policy before using those services.
The Municibid ChatGPT App is designed to return public auction, listing, and seller or agency summary information. It does not expose bidder identities, private seller contact information, payment information, invoice information, or internal Municibid business metrics.
The Municibid ChatGPT App is read-only. It does not place bids, create listings, modify User Accounts, process payments, or complete transactions. All bidding, account activity, payments, and transactions occur on Municibid.com and remain subject to Municibid’s Terms of Use.
California Privacy Rights
California residents have a right to request that Municibid disclose what Personal Data it collects from them and whether, and how, Municibid discloses or sells that Personal Data. California residents may also request that Municibid delete Personal Data collected or maintained by Municibid about the User.

Rights as a User
Right to Access and Correction
Users may request that Municibid confirm whether Municibid is processing the User’s Personal Data and what Data Municibid is processing. If a User’s information is incorrect or incomplete, the User may request that the information be corrected or completed. If Municibid has shared the User’s information with third parties, Municibid will inform those third parties of the correction to the extent required by law.
Right to Erasure
If the legal requirements exist, Users may request immediate deletion of their Personal Data from Municibid. This may apply when:
- The User’s Personal Data is no longer needed for the purposes for which it was collected;
- The legal basis for processing was the User’s consent only, and the User has revoked consent;
- The User has objected to processing for promotional purposes;
- The User has objected to processing based on a legitimate interest for personal reasons, and Municibid cannot prove that there are legitimate reasons for processing;
- The User’s Personal Data has been processed unlawfully; or
- The User’s Personal Data must be deleted in order to comply with legal requirements.
If Municibid has forwarded the User’s Data to third parties, Municibid will inform the User about deletion insofar as required by law. Please note that the User’s right to erasure is subject to restrictions. For example, Municibid may not or must not delete Data that Municibid still needs to retain due to legal retention requirements. Data that Municibid needs in order to assert, exercise, or defend legal rights is also excluded from the User’s erasure right.
Right to Object to Processing
If the legal requirements are met, Users may request a limitation of Data processing from Municibid. Relevant circumstances include when:
- The User disputes the accuracy of the User’s Personal Data and Municibid must have the opportunity to verify it;
- The processing is not lawful, and the User requests a restriction of use instead of erasure;
- Municibid no longer needs the User’s information for the purposes of processing, but the User needs it to assert, exercise, or defend rights; or
- The User has raised an objection for personal reasons, and Municibid must evaluate the objection.
If the User can show a valid right to restrict processing, Municibid will mark the Data in question to ensure that it is processed only within the limits that apply to such restriction, such as to defend legal claims or within the parameters of the User’s consent.
Right to Data Portability
Users have the right to receive personally identifiable information they have given to Municibid for fulfillment of a contract or on the basis of consent in a transferable format. In this case, Users may also request that Municibid transmit this Data directly to a third party, insofar as technically feasible.
Right to Revoke Your Consent
If the User has given Municibid consent to the processing of the User’s Data, the User may withdraw it at any time for future processing. The lawfulness of the processing of the User’s Data prior to revocation remains unaffected.
Right to Object to Direct Marketing
Users may object at any time to the processing of their Personal Data for advertising purposes. Please note that there may be an overlap between a User’s revocation and the use of the User’s Data as part of an ongoing campaign.
Right to Object for Personal Reasons
Users have the right, for reasons that arise from their particular situation, to object to Municibid’s processing of their Data to the extent that the processing is based on a legitimate interest. Municibid will then stop processing the User’s Data unless Municibid can, in accordance with legal requirements, prove compelling legitimate reasons for further processing that outweigh the User’s rights.
European Union Right of Appeal to a Supervisory Authority
European Union residents have the right to file a complaint with a data protection authority. In particular, EU residents may contact the data protection authority responsible for their place of residence or state, or the authority responsible for the place where the alleged violation of data protection law occurred.
Asserting Rights
If a User wishes to assert any of the rights described above, the User should submit the request by providing the User’s current address, date of birth, and email address to:

Municibid will use the information provided in such request exclusively for comparison with information in Municibid’s database and to protect the User’s Personal Data against access by unauthorized third parties.
